This petition has been filed for quashing of FIR No.47/2022, PS Roop Nagar, under Sections 498A/406/34 IPC, on grounds of settlement arrived at between parties through the facilitation of Delhi Mediation Centre, Tis Hazari Courts dated 09th January, 2024. Petitioner No.1 and Respondent No.2 were married on 16th January, 2020. A girl child was born out of their wedlock. She is now under the care and custody of her mother. Due to matrimonial discord, the marriage resulted in a divorce vide decree dated 11th March, 2024.

The settlement is on record of this Court, as per which Rs.21 Lacs have to be paid as part of the settlement, out of which, the outstanding balance of Rs.50,000/- has been handed over to respondent No.2, who has duly received The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and acknowledged the same. Petitioner Nos.1-5 and respondent No.2 are present in Court and duly identified by the IO. 3.

Considering the above settlement between parties and the chances of conviction of petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of Court and an unnecessary burden on State exchequer. Accordingly, petition is allowed. Consequently, FIR No.47/2022 PS Roop Nagar under Sections 498A/406/34 IPC and proceedings emanating therefrom are quashed. 4.

Parties shall abide by terms of settlement.

Accordingly, petition is disposed of. Pending applications (if any) are disposed of as infructuous.

It is however made clear that said settlement will not affect the rights of the minor child in future.
