% 20.01.2020 I.A.705/2020 (Joint Application on behalf of the plaintiff and defendant under Order XXIII Rule 3 of the CPC, 1908) 1.

The parties have filed a joint application under Order XXIII Rule 3 of the Code of Civil Procedure, 1908, for disposal of the present suit in terms of a settlement arrived at between them. The terms of the settlement are recorded in paragraphs 5 and 6 of the application. 2.

The application is signed by the authorised representatives of both the parties, as well as by their counsel. The authorised representative of the plaintiff, being the Head (Legal) and Company Secretary, and the authorised representative of the defendant have also filed affidavits in support of this application.

Having regard to the material placed on record and the submissions of learned counsel for the parties, I do not find any impediment to passing of a decree in terms of paragraphs 5 and 6 of the application. The decree sheet shall be prepared accordingly. A copy of this application shall form part of the decree.
