This is a joint application under Order XXIII Rule 3 read with Section 151 CPC between the Plaintiffs and Defendants No. 1 to 4 bringing on record the settlement between the parties and for passing a decree in terms of the settlement.

Learned counsel for the Plaintiffs points out that a decree has already been passed qua Defendant No. 5 by order dated 12.09.2025 based on an undertaking given by said Defendant, as recorded in the said order. 3.

Court has perused the terms of settlement which are incorporated and extracted in paragraph 3 of the application and finds the settlement to be lawful. Learned counsel for Defendants No. 1 to 4 also states that as agreed, payment of Rs.2.5 lakhs has been paid to the Plaintiffs and the only other obligation that remains to be fulfilled is the destruction of impugned goods, which will be done within a period of one week from today and a video recording shall be shared with the counsel for the Plaintiffs. 5.

Accordingly, the application stands disposed of, recording the settlement.

This suit is filed by the Plaintiffs for declaration, permanent injunction restraining infringement of trademarks and passing off, infringement of design, dilution, tarnishment, unfair competition, delivery up, damages and rendition of account.

The suit is decreed in terms of the settlement between the parties incorporated in paragraph 3 of the application. 8.

Registry shall draw up the decree sheet.

Suit stands disposed of along with all pending applications. 10.

Plaintiffs are held entitled to refund of entire Court fees in accordance with Court Fees Act, 1870.
