On 23.03.2026, this Court recorded that the parties have entered into a Settlement Agreement dated 29.01.2026.

A joint application being I.A. 7619/2026 has been filed under Order XXIII Rule 3 of the CPC for passing a decree in terms of the Settlement Agreement dated 29.01.2026 which has been arrived at between the parties. However, the joint application had not been signed by all the Defendants and therefore the matter was adjourned for today, i.e., 06.04.2026, to enable the parties to file affidavits agreeing to the Settlement Agreement dated 29.01.2026.

The affidavits of Defendants No.3, 4 and 5 have now been filed stating that they have read and understood the contents of the Settlement The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

This Court has also perused the terms of the Settlement Agreement dated 29.01.2026, which are lawful in nature and accordingly, the Suit can be disposed of in terms of the Settlement Agreement dated 29.01.2026, under Order XXIII Rule 3 of the CPC.

The Plaintiff has also given a separate statement in Court stating that he has signed the Settlement Agreement dated 29.01.2026 after having read the contents, without any coercion, force or undue influence. 8.

The Defendants who are present through video-conferencing also state that they have read the contents of the Settlement Agreement dated 29.01.2026 and Defendants No.3, 4 and 5 have filed affidavits acknowledging the contents of the Settlement Agreement dated 29.01.2026 and state that a decree be passed in terms of the Settlement Agreement dated 29.01.2026.

This Court is of the opinion that the ingredients under Order XXIII Rule 3 of the CPC have been satisfied. Let the decree sheet be drawn up according to the Settlement Agreement dated 29.01.2026. 10.

The parties are bound by the Settlement Agreement dated 29.01.2026. 11.

In view of the fact that the settlement has been arrived at between the parties, let the entire court fee be refunded to the Plaintiff in terms of Section 16 of the Court Fees Act, 1870.
