Learned counsel appearing for the respondent raises preliminary objections with respect to the maintainability of the instant petition on the ground that the nature of relief sought by the petitioner is covered under the Works of Licensees Rules, 2006. According to him, in terms of the said Rules, the petitioner has to approach the concerned Executive Magistrate. He also places reliance on a decision of this Court dated 20.01.2020 in the case of Kalyani India Pvt. Ltd. v. Govt of NCT of Delhi and Ors.2 to substantiate his stand.

Learned counsel for the petitioner contends that in view of the aforesaid, he would like to withdraw the petition with liberty to approach the concerned authority.

In view of the aforesaid, the instant writ petition is disposed of with directions to the District Magistrate/Divisional Commissioner to treat this petition as a representation to have been submitted by the petitioner and to pass an appropriate order within a period of twelve weeks from the date of receipt of a copy of this order. Let a copy of the petition with all annexures be placed by the petitioner before the authority concerned. 4.

Let an opportunity of hearing be also extended to all concerned.
