This is an execution petition filed under section 36 of the Arbitration and Conciliation Act, 1996 seeking execution of the Arbitral Award dated 12.03.2023.

During the pendency of this petition, the parties have subsequently arrived at a Settlement Agreement dated 18.03.2024. The entire amount under the said settlement has been paid to the decree holder. 3.

Mr. Taneja, learned counsel for the judgment debtor states that the TDS amount has been deducted and in this regard, the TDS certificate shall be issued within 4 weeks from today.

Since the matter has been settled, Mr. Bagga, learned counsel for the decree holder does not press the present execution petition and hence, the same is disposed of as having being infructuous. 5.

The next date of hearing i.e. 22.07.2024 stands cancelled. EX.APPL.(OS) 993/2024-FOR REFUND OF DEPOSITED AMOUNT 6.

the amount of Rs. 8,70,19,057/- along with accrued interest. 7.

Since the matter has already been settled and the entire payment has been made to the decree holder, the judgment debtor is entitled to the refund of the amount deposited in this Court. 8.

It is therefore directed that the amount of Rs. 8,70,19,057/- along with up-to-date accrued interest be released in favour of "NTPC Ltd." and/or through its authorized representative.

The application is allowed and disposed of.
