The present petition seeks rectification of Respondent No. 1's trademark registration no. 1712358 for the mark "PLAYNOW" in Class 41 ("Impugned Mark") from the Register of Trade Marks under Section 11(2), 11(10), 47(1), 18(4) read with Section 57 of the Trade Marks Act, 1999. 2.

Counsel for Petitioner states that since the Impugned Mark has lapsed on 21st July, 2018, and as no renewal has been applied for till date, the present petition is rendered infructuous.

Mr. Alexander Mathai Paikaday, counsel for Respondent No. 2 (Registrar of Trade Marks), states that they will take appropriate steps to remove the entry of the Impugned Mark from the register.
