An application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for grant of interim bail for a period of four weeks in FIR No. 398/2020, under Sections 394/397/342/452/506/34 IPC read with Sections 27/54/59 of Arms Act registered at P.S. Dayalpur. Section 120B IPC has been subsequently invoked by the prosecution.

Issue notice. Learned APP for the State appears on advance notice and accepts notice.

Learned APP for the State opposes the application and submits that status report was filed before the learned trial court, whereby it was informed that presence of petitioner is not required for purpose of proposed admission of the children in school, since a guardian or wife of petitioner can appear for said purpose. Further admission process is stated to be not scheduled as on date.

In the facts and circumstances, no grounds are made out for releasing the applicant on interim bail. Application is accordingly dismissed. Pending applications, if any, also stand disposed of. Nothing stated herein shall tantamount to expression of opinion on the merits of the case.
