A Criminal Leave Petition under Section 378(3) Cr.P.C has been filed on behalf of the Petitioner for grant of Leave to Appeal against the Judgment dated 25.03.2019 passed by learned ASJ, West District, Delhi in FIR No.196/2013 under Section 363/366 IPC P.S. Ranhola. 2.

It is submitted that the Order of the learned Trial Court is based on imagination, conjectures and surmises. The acquittal of the Respondent is not based on factual matrix of the case. The evidence led by the Prosecution during the trial was not properly appreciated leaving to acquittal of the Accused. The Accused/Respondent has been given benefit of minor contradictions/improvements which were not fatal to the prosecution case. Hence, a prayer is made for grant of Leave to Appeal. 3.

In view of the submissions made and the reasons given in the Leave Petition, the same is allowed.
