In this second call, learned counsel for both sides have come with instructions from their respective clients, whereby the petitioner/tenant undertakes to vacate the subject premises on or before 31.12.2024 and the respondents/landlords shall not claim use and occupation charges till that day. With these instructions, learned counsel for petitioner seeks permission to withdraw the present petition.

Accordingly, the present petition is dismissed as withdrawn with the directions that operation of the impugned eviction order shall remain stayed till 31.12.2024 and till that day, the petitioner/tenant shall not be liable to pay any use and occupation charges to the respondents/landlords. However it is clarified that in case the petitioner/tenant does not vacate the subject premises on or before 31.12.2024, the respondents shall be liberty to get the impugned eviction order executed in accordance with law. 3.
