This petition has been filed seeking quashing of FIR No. 1288/2021 under Sections 498A/406/506/34 IPC, registered at P.S Sultan Puri, on the basis of settlement arrived at between the parties with the facilitation of the Delhi Mediation Centre, Tis Hazari Courts dated 01st November, 2023, which is on record of this Court.

Petitioner and respondent no.2 were married on 23rd February, 2012. One male child was born out of wedlock.

Due to marital discord, the marriage has resulted in a divorce by decree dated 28th March, 2024.

As per the settlement, the balance amount of Rs.3,50,000/- (Three Lacs Fifty thousand) is tendered to respondent no.2 in the Court today by way of a Demand Draft No. 013488 dated 15thJuly, 2024 drawn on SBI; she acknowledges the same and states that she has no objection to quashing of the FIR.

Petitioner nos. 1-2 and respondent no.2 are present in Court and are duly identified by the IO. Petitioner no.3 is present through VC and is duly identified by the IO.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 1288/2021 under Sections 498A/406/506/34 IPC registered at P.S Sultan Puri and proceedings emanating therefrom are quashed.

It is however made clear that the said settlement will not affect the rights of the minor child in future.

Parties shall abide by the terms of settlement. 9.
Accordingly, the petition is disposed of. Pending application, if any, is disposed of as infructuous.

Copy of the order be given dasti under the signature of the Court Master. 11.
