Allowed, subject to all just exceptions. Application is disposed of. CONT.CAS(C) 963/2025 3.

The present contempt petition under Section 12 of the Contempt Of Courts Act, 1971, has been filed seeking the following prayers:- "A. Direct Initiation of proceedings for contempt against the respondent for deliberate and wilful disobedience of the order dated 06-12-2024 passed by the Hon'ble Court in W. P. (C) 16926 of 2024 in the matter of Raj ender Kumar Vs Sh. Anil Kumar Singh, The Registrar, Delhi Cooperative Societies and punish with both fine and imprisonment in accordance with the law;

B. To award litigation cost in favour of the petitioner/applicant who . IS as Senior Citizen and against the respondent/contemnor for causing avoidable expenditure as litigation etc.

within a stipulate timeline, in accordance with law and/or D. Pass such other further order/ orders as this Hon'ble Court may deem fit and proper in the interest of justice and in the facts and circumstances of the present case."

Learned counsel appearing on behalf of the petitioner submits that vide judgment dated 06.12.2024 passed by learned Division Bench in W.P.(C) 16926/2024 in terms of paragraph 5, the respondent was supposed to pass a reasoned and speaking order on the petitioner's representation dated 14.11.2024 within a period of three months from the date of passing of the said order.

Learned counsel appearing on behalf of the petitioner submits that after filing of the present petition, they called the petitioner for hearing and subsequently, order dated 27.05.2025 had been passed, which as per the submissions of learned counsel appearing on behalf of the petitioner, is a nonspeaking order. 6.

Learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings in accordance with law with respect to the order dated 27.05.2025 passed by respondent/Registrar, Delhi Cooperative Societies, on the representation of the petitioner.

Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of accordingly.
