Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (earlier as Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioners, for quashing of FIR No.316/2025 under Section 420/468/471 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Nihal Vihar, Delhi and all the consequential proceedings emanating therefrom, in view of the Settlement dated 14.06.2025.

On advance Notice, learned ASC (Crl.) has appeared and accepted the Notice on behalf of the State.

The nature of the dispute is that the Complainant was a tenant and the Respondent No. 2 was the owner of the Property in question, which he has let out to the Petitioner No. 1, who in turns sublet the premises to the Petitioner No. 2, who got a forged Rent Deed executed in her favour. On the Complaint of the Respondent No.2/Complainant, FIR No.316/2025 under Section 420/468/471 and 34 IPC, got registered at Police Station Nihal Vihar, Delhi.

It is stated that the Petitioners and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 14.06.2025. It is stated that the Petitioners shall pay a sum of Rs.3,60,000/- towards full and final settlement of all the claims in all respect of the Respondent No. 2. 7.
In terms of the Settlement, the keys and a Demand Draft bearing No. 892444 dated 15.09.2025, drawn from South Indian Bank, Rohini, Delhi, issued in favour of Jitender Singh Yadav, in a sum of Rs.3,60,000/-, is handed over to the Respondent No. 2, which is accepted by him. 8.
Today, the Respondent No. 2, who is present in the Court, states that he has received all amounts due to him and has no objection if the said FIR is quashed.

The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 10.
Considering the nature of the allegations and that they have settled the matter, the FIR No. No.316/2025 under Section 420/468/471 and 34 IPC, registered at Police Station Nihal Vihar, Delhi and all the consequential proceedings emanating therefrom are quashed, 11.
The Petition is disposed of accordingly.
