CORAM:

HON'BLE MR. JUSTICE MANMOHAN

O R D E R

% 29.03.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 29th August, 2016 passed in W.P.(C) No.7573/2016, whereby the respondent-Directorate of Education was directed to treat the petitioner's writ petition as a representation and pass a reasoned order within four weeks.

Today Mr.Satyakam, learned ASC for GNCTD has handed over a copy of the speaking order dated 28th March, 2017. The same is taken on record. The relevant portion of the speaking order dated 28th March, 2017 is reproduced hereinbelow:- "Therefore, I, Dr.SMS Kujur, DDE (SE), hold that in the light of the above reasons the suspension order passed by the Management of the school, lacks compliance of due process of law & hence void due to non-approval of Director (Education) and the Management of the school is directed to allow the petitioner, Ms.Ipsa Gurnani, to join duty and to pay her full salary along with all the allowance and benefits with

immediate effect. Needless to add the period of her illegal suspension will be treated as „Spent on Duty‟. This disposes of representation of the petitioner in terms of the court‟s order dated 29.08.2016 in WPC 7573 of 2016. This issues with the approval of the Competent Authority." In view thereof, present contempt petition is disposed of as satisfied and the notices issued are discharged. MANMOHAN, J MARCH 29, 2017 KA
