The present petition has been filed by the Petitioner, inter alia, seeking issuance of appropriate directions to the Respondents to not disturb the vending activities of the Petitioner and to allow him to peacefully vend from his vending site.

The Petitioner herein is a street vendor, who is stated to have been operating a vending cart at the vacant place near the pavement of the service road, opposite Kailash Colony Metro Gate No.2, Bodofa Upendra Nath Brahma Road, Kailash Colony Metro Station, South Zone, Ward, S-86 (hereinafter, 'the vending spot'). It is his case that he has been vending since 2007.

It is submitted on behalf of the Petitioner that recently, however, he has been facing harassment and hardships and has not been permitted to carry out the vending activities due to obstructions by MCD officials and police personnel.

A perusal of the vending certificate of the Petitioner reveals that he has been categorized as 'Others' in the certificate of vending. It is the submission on behalf of the Petitioner that he only has a mobile cart and is willing to comply with all the conditions of the vending certificate. The prayer, therefore, is that he should be allowed to peacefully vend at the vending spot. 6.
Ms. Kalra, ld Counsel appearing for the Municipal Corporation of Delhi submits that as per the vending certificate, the Petitioner is a mobile vendor and he cannot be stationed at one place. 7.
She further submits that the Lala Lajpat Rai Marg is a no vending zone and the Petitioner cannot be allowed to vend in the said area. Thus, it is directed that this fact shall be borne in mind by the Petitioner and he shall comply with the same.

The Court has seen the photographs of the Petitioner's vending cart, which shows that the same is a mobile vending cart. Accordingly, it is directed that the Petitioner shall not be disturbed in carrying out vending activities, as long as he is complying with the terms and conditions of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
