Mr. Kaushik, learned counsel for the petitioner states that a petition filed under section 11 of the Arbitration and Conciliation Act, 1996 is pending before the Hon'ble Supreme Court.

He states that since it is an international arbitration, the same is pending before the Hon'ble Supreme Court and is likely to be listed soon. Thus, learned counsel for the petitioner on instructions seeks to withdraw the present petition with liberty to take all permissible remedies available in law before the arbitrator as and when appointed. 3.

Mr. Sibal, learned senior counsel on instructions states that respondent has no objection to the appointment of an arbitrator. 4.
