After some hearing, learned counsel for the parties request that an arbitrator be appointed to decide the disputes between the parties and the present petition be treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996 ["the Act"], before the learned arbitrator.

With the consent of learned counsel for the parties, the petition is disposed of by appointing Hon'ble Mr. Justice S. Judge, Supreme Court of India [Tel: 9818000160] as the learned arbitrator to adjudicate the disputes between the parties under a Share Purchase Agreement dated 16.04.2024. The arbitration will be held under the aegis of Delhi International Arbitration Centre, Delhi High Court, Shershah Road, New Delhi-110503 ["DIAC"], and will be governed by the Rules of DIAC, including as to the remuneration of the learned arbitrator.

The learned arbitrator is requested to furnish a declaration under Section 12 of the Act, prior to entering upon the reference. 4.
The present petition will be treated as an application under Section 17 of the Act before the learned arbitrator. The respondent may file a reply to the application under Section 17 of the Act, within ten days from today or as soon as the learned arbitrator enters upon the reference, whichever is later.

The parties may request the learned Arbitrator to take up the application under Section 17 of the Act for expeditious hearing, at least for the purposes of ad interim relief.

The petition stands disposed of in the above terms.
