This petition has been filed, under Section 29A of the Arbitration and Conciliation Act, 1996, seeking an extension of the mandate of the learned Arbitral Tribunal, which is in seisin of disputes between the parties arising out of Agreement No. 28/DL/2009-10, entered into between the parties pursuant to a notification of acceptance dated 22.05.2009.

The mandate of the learned Arbitral Tribunal was extended, lastly by order dated 19.12.2023 in O.M.P.(MISC.)(COMM.) 198/2023, until 18.06.2024.

Although the contentions in the petition are disputed by learned counsel for the respondent, who appears on advance notice, learned counsel states that the respondent has no objection to the extension of the mandate of the learned Arbitral Tribunal.

I am informed that the examination of the claimant's witness is in progress. Learned counsel for the parties, therefore, jointly request an extension of the mandate for the period of one year, although the prayer clause in the petition seeks an extension of only six months. 5.

Having regard to the aforesaid facts, at the request of learned counsel for the parties, the mandate is extended by one year, with effect from 18.06.2024. Learned counsel for the parties assure the Court that they will cooperate with the learned Arbitral Tribunal so that the proceedings can be disposed of within this time. 6.

The petition stands disposed of in these terms.
