% 28.10.2025 Mr. Deepak Agarwal, learned counsel appearing for the appellant seeks leave to withdraw the present appeal, submitting that the matter has been settled through mediation in the execution proceedings.

A copy of the Settlement Agreement dated 18.09.2025, to that effect, has been shown to the court.

In view of the above, the appeal is disposed-of as withdrawn. 4.
Pending applications, if any, also stand disposed-of. 5.
Furthermore, counsel requests for refund of the court-fees affixed on the memo of the appeal.

The matter is at the notice stage.

In view of the decision of a Division Bench of this court in Nutan Batra vs. M/s Buniyaad Associates1, the Registry is directed to refund the entire court fee(s), since the parties have settled the matter through mediation which attracts the applicability of section 16 of the Court Fees Act.

The Registry is directed to draw-up the requisite certificate in favour of the appellant within 02 weeks.
