The present petition has been filed seeking removal/rectification of the mark 'EUROFOBES' bearing no. 1840465 in Class 11 from the Register of Trade Marks.

When the matter was listed for hearing on 30th January, 2025, learned counsel appearing for the respondent had submitted that the respondent had already closed his business and was no longer using the mark in question. He had further submitted that the respondent had no objection if the rectification petition was allowed.

Today, Mr. V.S. Dubey, learned counsel appearing for the respondent reiterates the said submission. The said submission is also confirmed by the respondent, i.e., Mr. Vahid Ali, who appears before this Court through video conferencing (VC).

Mr. Vahid Ali, the respondent appearing in person, submits that he has no objection if the mark in question is cancelled. 5.
Accordingly, with the consent of the parties, it is directed that the registration no. 1840465 in Class 11, in the name of the respondent for the mark 'EUROFOBES', is hereby cancelled.

The Registrar of Trade Marks is directed to rectify its register accordingly, and issue requisite notification in that regard. 7.
The Registry is directed to supply a copy of the present order to the Office of the Controller General of Patents, Designs and Trade Marks of India, on E-mail Id: llc-ipo@gov.in, for compliance. 8.
With the aforesaid directions, the present petition is allowed and accordingly disposed of.
