None appears for the parties when the matter is called out. 2.

The present petition has been filed seeking rectification/cancellation of the trademark 'PAURUSH JEEVAN (LABEL)' bearing no. 709971 registered in Class-05, in relation to Ayurvedic medicines, medicinal and pharmaceutical preparation, in the name of respondent no.1 for being deceptively similar and identical to the trademark of the petitioner, i.e., 'NAVPAURUSH'.

This Court notes that the last appearance on behalf of the petitioner was on 19th December, 2023. Thereafter, none has been appearing for either the petitioner or the respondent.

Owing to non-appearance of the parties, fresh service was done. nd April, Perusal of the order sheets show that the petitioner was served on 22 2024. The respondent no.1 was also served through his registered Trademark Agent on 20th March, 2024.
