O.M.P. (T) (COMM.) 87/2019 The present petition has been filed by the petitioner under Section 14 and 15 of the Arbitration and Conciliation Act, 1996 for termination of the mandate of the nominee Arbitrator of the respondent Authority and substitution thereof.

Mr. Bharat Singh, learned counsel appearing for the National Highway Authority of India (in short 'NHAI') on advance notice states that the Authority is in receipt of a communication from Dr. B.K. Sinha nominee Arbitrator expressing his inability to continue with the arbitration proceedings. He states pursuant thereof, the Authority has initiated the process of appointing its nominee Arbitrator and the nominee

Arbitrator shall be appointed within a period of three weeks as an outer limit.
