Perusal of the order sheets show that the petitioner has not put in appearance before this Court even once.

Order dated 15th July, 2024, in this regard, reads as under:

"The service report of the petitioner is once again awaited, like they were for the last few hearings. Despite repeated efforts, the service could not be affected over the petitioner. Moreover, none has appeared for the petitioner ever on its own.

List the matter before the Hon'ble Court for further directions on 25.09.2024."

Perusal of the record shows that the present petition was initially filed before the Intellectual Property Appellate Board ("IPAB"), and was thereafter transferred before this Court, upon abolition of the IPAB. 4.

Order sheets of the IPAB are on record, perusal of which, show that there has been no appearance on behalf of the petitioner even before the IPAB since the year 2018.

Accordingly, it is manifest that the petitioner is no longer interested in pursuing the present matter.
