This is an application seeking regular bail, filed on behalf of applicant/accused Sahil in case FIR No. 0399/2024 under Sections 318(2)/319(1)/212/3(5)/61(2) of BNS, 2023 and Sections 10(1) and 11(1) of Public Examination (Prevention of Unfair Means) Act, 2004, registered at Police Station RK Puram.

Learned counsel appearing for the applicant submits that out of ten accused, seven have already been granted concession of bail by learned Sessions Court. Investigation is complete and charge sheet has already been filed in Court.

He further submits that trial is progressing at a snail's pace and is unlikely to be completed soon as prosecution has cited as many as 27 witnesses, most of them are Police officials, Government teachers and nodal The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Most of such witnesses, being employees of the State, are beyond the reach of applicant, and therefore, there is no possibility of him influencing, threatening or intimidating them. The applicant has been in custody for more than six months. Nothing is left to be recovered from his possession as all the recoveries have already been affected.

The application has been opposed by the learned APP appearing for the State, submitting that ten persons, including the present applicant were caught at the examination center conducting the LDC examination, with an unauthorized Bluetooth attached with device to solve the question paper being conducted by the National Institute of Educational Planning and Administration in 2024 Examination.

Learned APP submits that applicant is not entitled for parity inasmuch as the applicant had hidden his identity and was also impersonating in examination in place of real candidate and a mobile phone was also recovered from his possession, which was being used for scanning the question paper, which was leaked outside, from the examination center. 6.
Admittedly, most of the co-accused persons have already been released on bail. Investigation is complete. The Bluetooth device and the mobile phone have since been recovered from the possession of the applicant, who is stated to be in custody since 23.12.2024. The applicant is, therefore, not required for any further investigation. The trial may take long time to conclude.

Hence, keeping in view the entire facts and circumstances, applicant/accused is admitted to bail, upon his furnishing a personal bond in the sum of Rs. 50,000/- with surety of the like amount to the satisfaction of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
