IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 2927/2019 ZEBA SAIFI & ANR.

..... Petitioners Through:

Mr Raina Shanker and Ms Renu, Advocates.

versus STATE & ORS.

..... Respondents Through:

Mr Avi Singh, ASC with Tanuj Bhadana, Advocates for State with SI Satyandev Panwar, PS Gokalpuri, Delhi.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 16.10.2019 CRL.M.A. 38278/2019 1.

Allowed, subject to all just exceptions.

W.P.(CRL) 2927/2019 2.

The petitioners have filed the present petition, inter alia, praying that directions be issued to respondent nos.1 to 5 to provide security and protection to the petitioners. The petitioners claim that they married against the wishes of the family members of petitioner no.1 (who are arrayed as respondent nos.6 and 7). The petitioners apprehend harm at the hands of respondent nos.6 and 7 and fear for their safety. They have, therefore, filed the present petition.

3.

Mr Singh, learned ASC appearing for the State submits that inquires were made and it was found that the petitioners are not residing at the address provided in the memo of parties (House No.357, D Block, Gokul Puri, Delhi-110094). He also points out that respondent no.5 is the SHO of Faridabad and it would not be apposite for this Court to issue directions to the said SHO.

4.

The learned counsel appearing for the petitioner disputes the above contention and states that the petitioners are residing at the address as provided (House No.357, D Block, Gokul Puri, Delhi-110094) and are in urgent need of protection.

5.

In view of the above, this Court considers it apposite to grant liberty to the petitioners to approach respondent no.4 (SHO, Gokulpuri). In the event, they approach respondent no.4, he shall ascertain their address and provide them such protection as he considers necessary. Respondent no.4 may also provide the contact numbers of the police station and of the beat staff to enable the petitioners to contact them in case of any emergency. 6.

No further orders are required to be passed in this petition. The same is disposed of.

7.

Order dasti under signatures of the Court Master. VIBHU BAKHRU, J OCTOBER 16, 2019 MK
