Procedure 1973, the petitioner/Mack Star Marketing Private Limited, which claims to be the victim on whose information FIR bearing No.RC0262020A0012 dated 23.09.2020 was registered under section 13(2) read with section 13(l)(d) of the Prevention of Corruption Act, 1988 and section 120-B read with sections 409/420 of the Indian Penal Code, 1860 at P.S.: ACB, Mumbai, seeks a direction to the respondent/CBI to expedite investigation and submit the final report under section 173(2) Cr.P.C. in a time-bound manner.
At the outset, Mr. Anupam S. Sharma, learned SPP appears on behalf of the CBI on advance copy; and submits, on telephonic instructions received from the Investigating Officer/Inspector Mr. Vipin Kumar Gupta, that the matter was investigated by ACB, Mumbai, and consequent thereupon, a chargesheet has been filed before the concerned court in Mumbai on 28.06.2024.
In view thereof, Mr. Siddharth Aggarwal, learned senior counsel appearing for the petitioner seeks leave to withdraw the present petition, with liberty to file afresh for the appropriate relief before the concerned court, as may be permissible, in accordance with law. Accordingly, the petition is disposed-of as withdrawn, with liberty as prayed-for; without making any observations on the merits of the matter. Pending applications, if any, also stand disposed-of.
