Petition under Article 226 read with Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the Petitioner, Amit Kumar Bidhuri for quashing of FIR No. 0053/2018 dated 14.03.2018 under Section 289 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Sarita Vihar and all the consequential proceedings emanating therefrom, in view of the Settlement dated 12.07.2024.

Brief facts of the case are that the Petitioner and the Respondent No. 2 are the family members. Petitioner is the grandson of cousin of Respondent No. 2. Both the parties are residing in the same village and same Mohalla. On 06.03.2018, there was an engagement program in the Village wherein father of the Petitioner and Respondent No. 2 have arguments. When Respondent No. 2 was returning home, the Petitioner was standing in front of his house with his pet dog having colour red and white. Thereafter, the Respondent No. 2 reached near him, the Petitioner instigated the dog by saying Hush and the dog on promoting, caught the right foot of the Respondent No. 2 and resultantly, he received injuries of dog biting. 5.

On the Complaint of the Respondent No.2/Complainant, FIR No. 0053/2018 dated 14.03.2018 under Section 289 of IPC, got registered at Police Station Sarita Vihar.

It is submitted that the FIR was a consequence of the family disputes between the Complainant and the Petitioner. With the intervention of relatives, friends and respectable members of the society, the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Settlement Deed dated 12.07.2024.

Today, the Respondent No. 2/Complainant, who is present in the Court, states that he has no objection if the said FIR is quashed. 8.

The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 9.
