Writ Petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the Petitioners, namely, Kamlesh Sharma, Inder Lal Sharma and Karan Sharma, for quashing of FIR No. 315/2023 dated 07.07.2023 under Section 420/34 of the Indian Penal Code, 1860, registered at Police Station Sarita Vihar and all the proceedings emanating therefrom, on merits. 2.
Learned ASC for the State, submits that the Charge-Sheet has already been filed against the co-accused, namely, Deepak Sharma. The Petitioners have failed to join the investigations and even the proceedings under Section 82 Cr.P.C., have been initiated against them. appearances, the State is handicapped in continuing with the investigations, to ascertain whether any offence is disclosed or not from the Complaint filed by the Respondent No. 2/Complainant.

Considering that the Petitioners have been avoiding to join the investigations, the Writ Petition seeking quashing of FIR, has no merits and is hereby dismissed with the directions to the Petitioners, to join the investigations, in accordance with law.

Writ Petition is disposed of accordingly. Pending Application, if any, also stands disposed of.
