% 04.11.2025 Mr. Vivek Kumar Tandon, learned counsel appearing for the appellant submits, that respondent has passed away on 30.03.2024; and consequently, the respondent's share has devolved equally upon the appellant and her 02 children, since the respondent passed away intestate. A copy of the death certificate of the respondent has been handed-up. The same is taken on record.

In view of the above, Mr. Tandon seeks leave to withdraw the present regular first appeal as having been rendered infructuous. The appeal is disposed-of as infructuous.
