+ CO.PET. 130/2016 THE TRADING HOUSE THROUGH ITS SOLE PROPRIETOR ..... Petitioner Through Mr.Sankalp Singh, Adv.

versus VANITY ENTERPRISES PVT. LTD.

..... Respondent Through Ms.Ruchi Sindhwani, Sr.Standing Counsel for Official Liquidator

CORAM:

HON'BLE MR. JUSTICE JAYANT NATH

O R D E R

% 07.02.2019 On 30.01.2018 this court had admitted the petition and appointed the Official Liquidator as the Provisional Liquidator. Direction was also passed to the petitioner to deposit a sum of Rs.75,000/- towards costs of publication. More than one year has lapsed. The petitioner has not been able to make the necessary payment holding up the winding up process. Today, learned counsel for the petitioner states that they are in financial difficulty and if given some time they will make the necessary payment. In my opinion, no ground is made out to extend the time for making payment. Petition is dismissed in default for non-prosecution. The order appointing the Official Liquidator as the Provisional Liquidator is revoked. JAYANT NATH, J FEBRUARY 07, 2019 n
