% 03.10.2018 Crl. M.A. No. 32357/2018 Disputes involved in this case are between the family members, i.e., petitioners and respondent nos. 2 to 4 regarding an immovable property bearing Khasra no. 261 (WZ-T-1), W.H.S. Kirti Nagar, New Delhi - 110015, which led to registration of a Kalandra under Section 145 Cr.P.C. and sealing of the aforesaid property on 28th September, 2007, pursuant to the order of S.D.M., New Delhi.
Petitioners preferred a Revision Petition before the Additional
Sessions Judge, which has been dismissed by the judgment dated 05.12.2017 impugned in this petition under Section 482 Cr.P.C. It is submitted that a Civil Suit bearing no. 260/2017 titled Sh. Ram Saran & Ors. vs. Shr. Ram Kumar & Ors. is also pending before the learned A.D.J. West District, Tis Hazari Courts, Delhi in respect of the aforesaid property. It is submitted that petitioners and respondent nos. 2 to 4 have settled their disputes amicably, vide a Compromise-cum-Settlement Deed dated 7th September, 2018. Photocopy of the Compromise-cum-Settlement Deed has been annexed with this application.
It is submitted that Crl. M.C. no. 738/2018 may be disposed of and property may be de-sealed. In view of the compromise arrived at between the parties, proceedings under Section 145 Cr.P.C. are quashed and the impugned order is set aside. Application is disposed of in the above terms.
CRL.M.C. 738/2018 Petition is disposed of as settled.
