O R D E R

% 23.01.2017 CO.APPL.69/2017 The present application under Rule 9 of the Company (Court) Rules, 1959 read with Section 151 of the Code of Civil Procedure, 1908 has been filed jointly on behalf of the parties to the accompanying contempt petition and prays as follows:- "a) The terms of settlement as recorded in the present application and more particularly set forth in the Memorandum of Settlement dated 02.01.2017 (Annexure C/1) be accepted by this Hon'ble Court and further parties be directed to be bound by such terms of settlement/compromise and the present application may be disposed of in terms thereof;

b) Pass appropriate order/direction as may be deemed fit and appropriate in the facts and circumstances of the case."

Although, none appears on behalf of the applicant/petitioner, the same is accompanied by affidavit of one Mr. Rajesh Modi, son of Mr. N.P. Modi, Director of the petitioner company, in support thereof. Having perused the Memorandum of Settlement dated 02.01.2017, it is observed that the said Memorandum of Settlement is lawful and the same is taken on record. The parties shall abide by the terms and conditions of the said

Memorandum of Settlement dated 02.01.2017, without demur. The application is accordingly disposed of.

CCP (CO.) 6/2014 Although none appears on behalf of the petitioner, in view of the foregoing, the present petition is disposed of as having become settled by way of the Memorandum of Settlement dated 02.01.2017. SIDDHARTH MRIDUL, J JANUARY 23, 2017 dn
