% 26.04.2016 After some arguments and when we were dictating the judgment, learned counsel for the petitioner submitted that he had urged and raised the contention that copy of the CVC advice, which was relied by the disciplinary authority, was not furnished to the petitioner. He seeks liberty to withdraw the writ petition and move a review application before the tribunal, as this aspect has not been examined and decided. Without expressing any opinion on whether or not said application would be maintainable or whether this contention was raised and argued before the tribunal, the writ petition is permitted to be withdrawn with liberty as prayed for. We clarify that this order will not be construed as an order expressing any opinion on merits.
