The present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (Corresponding to Section 482 of the Code of Criminal Procedure, 1973) is directed against order dated 18th January, 2025, passed by the Court of Additional Session Judge-09, West, Tis Hazari Courts, Delhi in CA No. 322/2024 titled as M W/o Y vs. Kamlesh Sharma. 2.

By the impugned order, the Sessions Court was upheld order dated 23rd July, 2024 passed by the JMFC (Mahila Court-04), West District, Tis Hazari Courts, Delhi, summoning the Petitioner on an application filed under Section 12 of the Domestic Violence Act, 2005. 3.

After making some submissions, counsel for the Petitioner states that he would like to withdraw the present petition and seeks liberty to urge all the grounds raised in the present petition before the Trial Court at an appropriate stage.
