% 12.02.2018 After some hearing, during the course of which it was pointed out that in view of the order made by the learned Single Judge on 20.12.2017, granting the relief in respect of prayer/claim (c), with respect to the other reliefs it was stated - "In view of the same, counsel for the petitioner submits that prayers (a) and (b) would stand satisfied and further orders are not required". It is submitted that now, in view of the subsequent developments, it would be necessary to seek an order for appointment of a Local Commissioner to take measurements at site to avoid further complications during the arbitration proceedings. Learned counsel seeks liberty to approach the Single Judge in this regard. Liberty granted.

The appeal is, accordingly, dismissed as withdrawn. Order dasti.
