The petitioner has filed this petition for appointment of an arbitrator, to adjudicate disputes between the parties in respect of lease deeds concerning property No. M-34, Ground floor, Greater Kailash - I, New Delhi. It appears that there were two lease deeds between the parties - the first dated 13.05.2003 and the second dated 03.05.2017. Both Lease Deeds contains arbitration clauses.

By a letter dated 04.01.2022, the petitioner has invoked arbitration with reference to the lease deed dated 13.05.2003. However, the claims for which arbitration is sought, according to learned counsel for the petitioner, arise out of the lease deed dated 03.05.2017. 3.

petitioner to invoke arbitration afresh, in accordance with law. 4.
Learned counsel for the respondent - Mahanagar Telephone Nigam Ltd. appears on advance notice and submits that he has been instructed that the respondent is willing to make an attempt to resolve its disputes with the petitioner by mediation. Having regard to the above, the parties are referred to mediation under the aegis of Samadhan, Delhi High Court Mediation and Conciliation Centre, Shershah Road, New Delhi-110503. They will appear before the learned mediator on 24.07.2024. 5.
In the event the mediation proceedings are unsuccessful, the petitioner is at liberty to take his remedies thereafter. 6.
The petition, alongwith pending application, is disposed of with these directions.
