O R D E R

The present writ petition has been filed seeking directions to respondent nos. 1 to 3, to stop the on-going unauthorized construction being undertaken by respondent no. 4 at premises situated at Gali No. 9, Chuna Mandi, Paharganj, Delhi-110055.

Responding to the present petition, learned counsel appearing for respondent no.1-Municipal Corporation of Delhi ("MCD"), appearing on advance notice, has handed over copy of certain documents to submit that the unauthorized construction in the property in question, has already been booked and accordingly a requisite Show Cause Notice has also been issued in this regard.

The said documents are taken on record.

Learned counsel appearing for the MCD submits that the requisite action shall also be taken in accordance with law. 5.

Accordingly, the MCD is held bound to take requisite action in the property in question after following the due process of law, expeditiously, preferably, within a period of six months from today. 6.

Further, no unauthorized construction shall be allowed in the property in question.

The Station House Officer ("SHO") of the local police station is also directed to ensure that no further unauthorized construction takes place in the property in question.

However, the legal right of respondent no.4, i.e., the occupier of the property in question, is reserved, to seek his remedies in accordance with law, in case he is aggrieved by any action of the MCD. 9.

With the aforesaid directions, the present petition, along with the pending application, is disposed of.
