The present petition under Article 215 of the Constitution of India, 1950, read with Section 12 of the Contempt of Courts Act, 1971 seeks the following prayers: - "a. Punish the Respondent No.1 in accordance with Section 12 of the Contempt of Courts Act, 1971, for willfully, intentionally and deliberately disobeying and regarding the Order dated 07.05.2024 passed by this Hon'ble Court in W.P.(C) No. 6425 of 2024 titled as "Sinu Gupta & Anr. vs. ICICI Bank & Anr."

b. Direct the Respondent No.1 to comply with the directions passed by this Hon'ble Court vide Order dated 07.05.2024 in W.P.(C) No. 6425 of 2024 titled as "Sinu Gupta & Anr. vs. ICICI Bank & Anr."

c. Any other Order(s) or Relief(s) or Directions(s) that this Hon'ble Court may deem fit and proper in the interest and furtherance of justice."

Vide order dated 07.05.2024 in W.P. (C) 6425/2024, learned Single Judge had passed the following directions: - "15. Be that as it may, without going into the aforesaid controversy, it is directed that the complaint sent by petitioner no. 2 vide Email dated 27th March, 2024, shall be considered by the respondentICICI bank.

16. The petitioners shall be granted a hearing by the concerned officials of the respondent-bank. Further, the respondent-bank shall also ensure that it shall comply with its Debt Management Policy with respect to giving the identity and authority of the persons, who are authorized to represent the bank for recovery of dues." 4.

Vide order dated 26.11.2025, this Court had passed the following directions: - "5. Learned counsel appearing on behalf of the respondent no. 1/ ICICI Bank submits that the petitioners will be granted personal hearing before the Legal Manager, ICICI Bank i.e. Mr. Sunil Singh (Address- ICICI Bank, Central Square, DCM Plaza - II, Manohar Lal Khurana Marg, New Delhi - 110005) on 27.11.2025 at 4:00 P.M.. He further submits that subsequent to the said personal hearing, the complaint sent by the petitioners will be considered and will be replied thereto."

Learned counsel appearing on behalf of the petitioners submits that the complaint has been decided; however the documents sought in the said complaint have not been handed over, which were incumbent upon the respondents to do.

The present petition has been filed seeking willful disobedience of the aforesaid order dated 07.05.2024 passed by the learned Single Judge, wherein the directions were given to the respondent to give a personal hearing to the petitioner and decide the complaint.
