% 20.03.2018 Learned counsel for the petitioner submits that the petitioner has no criminal record and has been falsely implicated. Nothing has been recovered from the petitioner. Investigation is complete, in as much as, chargesheet has already been filed. Prosecution's case is wholly based on circumstantial evidence and there is no independent evidence to connect the petitioner with the alleged offence.
Learned APP submits that petitioner along with co-accused committed theft of 100 of spare parts of Bajaj three wheelers from a shop. Certain other articles including TV and mobile phones were taken away by the petitioner and the co-accused by hiring a tempo. Keeping in mind the totality of facts and circumstances, it is ordered that petitioner be released on bail, subject to his furnishing a personal bond
in the sum of `10,000/- with one surety in the like amount to the satisfaction of the trial court.
