O R D E R

The present Writ Petition, under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita ("BNSS"), has been filed by the Petitioner seeking the following reliefs:

"(A) Pass a Writ, order or direction in the nature of Habeas Corpus or any other appropriate writ directing the jail authorities to immediately release the Petitioner from the illegal detention despite being granted bail by the Hon'ble Court of Ms. Divya Arora, Ld. JMFC, North West District, Rohini Court, Delhi vide order dated 04.06.2025 in FIR No.469/2023 PS Keshav Puram and furnishing bail bonds to the satisfaction of the Ld. Trial Court.; and grant reasonable compensation in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(B) Pass appropriate directions to the Prison Authorities to not withhold the release of the Petitioner on the basis of production warrants ostensibly issued by concerned Courts inside or outside Delhi and follow the mandate of law;

(C) Pass any other order as it may deem fit in the interest of justice, equity and good conscience." 2.

Learned counsel for the Petitioner submits that an FIR bearing No. 0469/2023, for the offence punishable under Sections 420/406 of the Indian Penal Code, 1860, was registered against the Petitioner at Police Station Keshav Puram, Delhi. The Petitioner applied for anticipatory bail; however, during the pendency of the said bail application, he was granted interim relief subject to his joining the investigation. It is further submitted that the said anticipatory bail application was subsequently dismissed by the learned ASJ, Northwest, Rohini Courts, Delhi vide order dated 04.08.2023. Thereafter, the Petitioner was arrested on 05.10.2023.

It is further submitted that vide Order dated 04.06.2025, the Petitioner was granted bail during the trial by the learned JMFC, North West District, Rohini Court, Delhi.

Thereafter, this Court vide Order dated 09.07.2025, took note of the fact that the Petitioner was not released on bail due to the failure to furnish bail bonds by the Petitioner. However, a Status Report, dated 11.07.2025, has been handed over and taken on record, which indicates that upon furnishing of requisite bail bonds by the Petitioner, he has been released on bail on 10.07.2025.
