Learned counsel for the plaintiff states that he seeks permission to withdraw the present suit with liberty to file a fresh suit on the same cause of action.

He states that the present suit suffers from formal defects and to avoid any objections being raised by the defendant on the form of the suit, he would like to make amends at this early stage. He, however, states that since this is the first date of hearing, the court fees paid for this suit may be permitted to be used by him for the fresh suit proposed to be filed on the same cause of action.

In view of the aforesaid submissions of the counsel for the plaintiff, the plaintiff is hereby granted permission to withdraw the suit with liberty reserved to the plaintiff to institute a fresh suit on the same cause of action, in accordance with law.

Further, subject to the plaintiff filing a fresh suit within a period of four (4) weeks from today, the plaintiff will be at liberty to use the court fees filed with the present suit in the proposed suit, in compliance with the rules.
