O R D E R

The present application is filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of interim bail in FIR No. 0699/2022 dated 10.12.2022, under Sections 308/34 of the Indian Penal Code, 1860, registered at Police Station Rajouri Garden.

The learned counsel for the applicant submits that the mother of the applicant is suffering from various ailments. He submits that she is not only suffering from the psychological disorder of depression, but is also diagnosed with Typhoid. She is also diagnosed with Erythema Multiforme Major, which is a rare serious disorder of skin, in which the patient develops painful rashes.

The Status Report filed by the State confirms that the mother of the applicant is suffering from depression, and that doctors have advised that she should be looked after by family members.

It is also not disputed that the father of the applicant is working in CRPF on the rank of ASI, and is currently posted in Jharkhand. It is further verified that the applicant has two sisters, who are both minors, being aged 9 years and 14 years respectively.

Considering the aforesaid facts, this Court considers it apposite to grant interim bail to the applicant for a period of two weeks from the date of his release on furnishing a bail bond of ₹25,000/-(Rupees Twenty Five Thousand Only) with one surety of the like amount, to the satisfaction of the Jail Superintendent, subject to the following conditions:

a. The applicant shall under no circumstances travel beyond the city during the period of interim bail; b. The applicant shall provide his active mobile number to the concerned Investigating Officer and keep his mobile phone on at all times;

c. The applicant shall not indulge in any criminal activity; and d. The applicant shall not try to contact or influence any of the prosecution witnesses.

The applicant is directed to surrender immediately after the expiry of two weeks from the date of release. 7.
