Learned counsel for the petitioner submitted that the documents, which the petitioner intends to file along with application under Section 294 of the Code of Criminal Procedure, 1973 (Cr.PC), would not be relied upon by the petitioner at the time of arguments on the point of charge. Learned counsel for the petitioner further submitted that he may be allowed to move an appropriate application along with the documents at an appropriate stage, in case the charge is framed against the petitioner and such an application may be disposed of in accordance with law.

Learned counsel for the respondent, who is present on advance notice, submitted that the documents relied upon, which the petitioner intends to file along with the application under Section 294 of the Cr.PC, are not relevant at all and he

opposes the prayer of the petitioner but has no objection if the petitioner moves such an application along with the documents and the application, if any, is disposed of in accordance with law by the Trial Court.

In view of the aforesaid submissions, learned counsel for the petitioner seeks permission to withdraw the petition. 4.

Accordingly, the petition is dismissed as withdrawn. It is clarified that this Court has not expressed any opinion on the maintainability of this petition or on the merits of the aforesaid application, if any, moved by the petitioner at any point of time before the Trial Court.
