The present petition is filed seeking leave to appeal against the judgment dated 16.12.2019, passed by the learned Special Judge, Karkardooma Courts, Shahdara District, Delhi in Sessions Case No. 145/18.

The reason which essentially weighed the mind of the learned Trial Court to acquit the respondent was that the victim's family and the family of the accused were not in a cordial relation.

The learned Trial Court also observed that the clothes of the victim were not torn from the front and, in such circumstances, merely holding the hand will not amount to outraging the modesty.

The MLC indicates that the victim had suffered swelling and redness on the forehead and had specifically alleged physical assault.

The respondent, however, has been acquitted of all the offences.

The victim is stated to be 17 years of age.
