CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 03.07.2018 Crl. M.A. no. 11815/2018 (for condonation of delay of 341 days in filing) By this petition under Section 397 Cr.P.C., petitioners have assailed the framing of charge against the petitioners under Sections 506/323/34 IPC by the trial court vide order dated 5th December, 2016. There is delay of 341 days in filing the present petition.

The only plea taken by the petitioners'

counsel is that petitioners could not arrange finances to file the Revision Petition. It may be noted that there is delay of 77 days in re-filing as well. This also shows callous attitude of the petitioners. In any case, vague plea taken by the petitioners is not sufficient cause to condone the delay of about

one year. Accordingly, application for condonation of delay is dismissed. Consequently, Revision Petition is also dismissed being barred by limitation. Miscellaneous applications are disposed of as infructuous. A.K. PATHAK, J.
