% 25.04.2017 Learned counsel for respondent draws attention of this Court to order of 26th August, 2015 to point out that petitioner had died and liberty was granted to legal heirs of petitioner to obtain Succession Certificate from concerned Civil Court. Although an application to bring on record the legal heirs of petitioner has been filed alongwith application seeking condonation of delay, but none appears on behalf of petitioner even on the second call.

This petition is dismissed in default.
