By the present petition, the petitioner challenges the notice dated 10.06.2025 issued by the Addl. Dy. Commissioner of Police-I, South-East District, New Delhi, under Section 50 of the Delhi Police Act, 1978 (DP Act), giving an opportunity to the petitioner to give an explanation regarding the allegations made in the notice and the proposed externment under Section 47 of the DP Act.

The learned counsel for the petitioner submits that the reason cited for the proposed externment is the pendency of five FIRs against the petitioner.

He submits that the petitioner has already been acquitted in three FIRs and cognizance is yet to be taken in one FIR. 4.

He submits that in such circumstances, no reason for issuance of notice exists.

Concededly, the notice only asks for explanation from the petitioner and no coercive order has been passed as yet. 6.

Therefore, the present petition, in the opinion of this Court, is premature.

The petitioner is at liberty to give all explanation as mentioned in the present petition, to the Authorities. 8.

Undisputedly, the Authorities will pass an order after considering the reply / explanation filed by the petitioner. 9.

Needless to state that the petitioner is at liberty to approach an appropriate forum in case any grievance remains in future. 10.

The present petition is disposed of with the aforesaid observations. Pending applications also stand disposed of. AMIT MAHAJAN, J JULY 10, 2025 'KDK'
