Pursuant to the order passed by this Court on 10th February, 2026, status report on behalf of the respondent-MCD has been handed over in Court today and the same is taken on record. It is stated in the status report that the common passage is not disturbed by the PVC water tank placed at the ground level and it adheres to 'Instructions and Guidelines for Building Permit and Completion Certificate in respect of DDA Flats'. A status report has also been filed on behalf of the Delhi Jal Board ('DJB') wherein it is stated that water connections have already been duly installed by the DJB in the flats in question, thereby ensuring supply of potable water. It is further stated that there is no specific provision under the Delhi Jal Board Act, Rules and Regulations with regard to placement, installation and positioning of PVC water storage tanks by individual residents within their premises.

Mr. Tushar Sannu, counsel appearing on behalf of MCD and DJB, submits that the water tank installed by the respondent no.3 has been removed.
3.1 This fact is confirmed by the counsel appearing for respondent no.3 as well.
