O R D E R

% 20.11.2018 Present suit has been filed for permanent injunction restraining infringement of trade mark, dilution, unfair competition, for rendition of accounts of profits/damages, delivery up etc. Present suit has already been decreed against defendant nos.5, 7, 8 and 9 and dismissed against defendant nos.10 and 11. Since defendant no.6 had expired before filing of the suit, the said defendant is also deleted from the array of parties. In pursuance to the last order, the authorised representatives of defendant nos.1 to 4 are personally present in Court. They state that they are not using the mark 'GATI'. They further state that they shall not use the mark 'GATI' either as a trademark or trade name or corporate name or domain name.

Learned counsel for the plaintiff states that in view of the aforesaid undertaking, he does not wish to press the present suit for any other or further relief.

The undertakings given by learned counsel for defendant nos.1 to 4 are accepted by this Court and the said defendants are held bound by the same. Registry is directed to prepare a decree sheet accordingly.

Consequently, the present suit and pending applications stand disposed of.
