Applicant seeks regular bail in case arising out of FIR No.757/2024 dated 21.10.2024, registered at P.S. Shahbad Dairy for commission of offences under Sections 85/80/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 498A/304B/34 IPC).

Admittedly, the death in question is suicidal in nature albeit under circumstances other than normal.

All the family members of the deceased have already been examined. 4.

brother and father of the deceased.

Copies of their deposition have been placed on record. 6.

The applicant herein-Kamal Saini is husband of the deceased, whereas his four co-accused persons were not arrested during the investigation. 7.

The applicant is in custody since 22.10.2024 and there does not seem to be likelihood of trial getting completed in near future as many other witnesses are yet to be examined.

Keeping in mind the overall facts of the case, albeit, without expressing any opinion over merits of the case, the applicant is, hereby, directed to be released on bail on his furnishing personal bond in a sum of Rs.25,000/- with one 'local' surety of like amount, subject to the satisfaction of learned Trial Court/CJM/ Duty Magistrate with the condition that he would provide his Mobile Number to the I.O. and would ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court. 9.

The application stands disposed of in aforesaid terms. 10.

A copy of this Order be immediately sent to the learned Trial Court and Jail Superintendent for information and necessary compliance.
